Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of PestBrief (available at pestbrief.com), operated by PestBrief LLC ("PestBrief," "we," "us"). By accessing or using the service, creating an account, or subscribing to any paid plan, you agree to be bound by these Terms. If you are accessing the service on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to that entity. If you do not agree to these Terms, do not use the service.

2. Service description

PestBrief provides a subscription-based data intelligence platform aggregating publicly available licensing, regulatory, and business information about pest control operators in the United States, beginning with Texas. The platform includes operator records, revenue estimates, M&A signal scores, a weekly brief newsletter, and associated analytical tools.

3. Data license and permitted use

Subject to your active subscription and compliance with these Terms, PestBrief grants you a limited, non-exclusive, non-transferable license to access and use PestBrief data for your own internal business purposes, including business development, market research, investment analysis, and sales prospecting.

Permitted: Viewing, downloading, and using operator records, signal scores, and deal data for internal business purposes; sharing specific records internally within your organization; using PestBrief analysis as a source citation in internal reports and memos.

Not permitted without written consent: Redistributing, reselling, sublicensing, or publishing PestBrief data to third parties; creating derivative datasets for commercial resale; incorporating PestBrief data into a competing product; bulk downloading or automated extraction of data beyond the export features provided by the platform.

4. Accuracy and disclaimers

PestBrief data is provided for informational purposes only. Revenue estimates, M&A signal scores, employee count estimates, and valuation ranges are derived from public records and proprietary modeling — they are analytical estimates, not appraisals, audited financial statements, investment recommendations, or guarantees of any kind.

PestBrief makes no representations or warranties about the completeness, accuracy, timeliness, or fitness for a particular purpose of any data in the platform. Data sources (government licensing registries, SBA filings, DOT records) are updated on their own schedules and may contain errors. You are solely responsible for independently verifying any information before making business decisions based on it.

5. Subscriptions and billing

Paid subscriptions are billed monthly or annually in advance. Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you retain access through the date you've paid for.

Refunds are available on request for annual subscriptions if requested within 7 days of the most recent charge and the subscriber has not exceeded 5 export operations in the billing period. Monthly subscriptions are non-refundable. We reserve the right to change subscription pricing with 30 days' notice to existing subscribers.

6. Prohibited uses

You may not use PestBrief to:

• Spam, harass, or contact individuals listed in our database in a manner inconsistent with applicable law, including the CAN-SPAM Act and TCPA
• Reverse-engineer, scrape, or systematically download PestBrief data outside of provided export features
• Circumvent or disable any access controls, rate limits, or security features
• Create a competing product or service using PestBrief data or methodology
• Share your account credentials with individuals outside your organization
• Use the service in any way that violates applicable federal, state, or local law

7. Intellectual property

PestBrief retains all intellectual property rights in the platform, including the signal scoring methodology, data aggregation system, platform software, and all associated analytics. The underlying public records that compose our database are not proprietary, but our compilation, enrichment, structuring, and scoring of those records constitute original intellectual property protected by copyright and database rights.

Nothing in these Terms grants you any rights in PestBrief's trademarks, logos, or service marks. Feedback you provide about the service may be used by PestBrief without restriction or compensation.

8. Limitation of liability

To the maximum extent permitted by applicable law, PestBrief's total cumulative liability to you for any claims arising out of or related to these Terms or the service — regardless of the theory of liability — is limited to the amount you paid to PestBrief in the 12 months immediately preceding the event giving rise to the claim.

PestBrief is not liable for indirect, incidental, special, exemplary, consequential, or punitive damages, including lost profits, loss of data, business interruption, or loss of goodwill, even if PestBrief has been advised of the possibility of such damages. These limitations apply to the fullest extent permitted by law.

9. Termination

Either party may terminate the subscription at any time as described in Section 5. PestBrief may suspend or terminate your access immediately if you materially breach these Terms, including unauthorized redistribution of data or abuse of platform systems. Upon termination, your license to access PestBrief data ends immediately. Sections 3, 4, 7, 8, and 11 survive termination.

10. Dispute resolution and governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from these Terms or the service will be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts. Before initiating formal proceedings, both parties agree to attempt good-faith resolution by contacting support@pestbrief.com.

11. Changes to terms

We may update these Terms from time to time. Material changes will be communicated by email to active subscribers with at least 14 days' notice before taking effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.

Privacy Policy

Information we collect

Account data: When you create an account or subscribe, we collect your email address, name, company name, and payment information. Payment data is processed directly by Stripe and is never stored on our servers.

Usage data: We collect information about how you use the platform — pages viewed, searches performed, records accessed, features used — to improve the product and monitor for abuse. This data is associated with your account.

Communications: If you contact us by email, we retain those communications to assist you and improve our service.

What we do not collect: We do not use third-party advertising cookies, social tracking pixels, or cross-site tracking technology. We do not purchase or import third-party contact lists.

How we use your information

We use your information to: provide and operate the service; send the weekly brief and product notifications (email opt-out links are included in every message); process payments via Stripe; respond to support requests; detect and prevent fraud or abuse; and analyze platform usage to improve the product. We do not sell your personal data to third parties.

Third-party service providers

We share data with the following categories of service providers who process it on our behalf: payment processing (Stripe), email delivery (Beehiiv), hosting and CDN (Cloudflare), database infrastructure (Supabase). Each provider is bound by their own privacy policies and applicable data protection law. We do not share your data with any other third parties without your consent, except as required by law.

Cookies and analytics

We use minimal first-party cookies for session management and authentication. Analytics are provided by Cloudflare Web Analytics, a privacy-first analytics system that does not use cookies, does not fingerprint users, and does not track users across sites. We do not use Google Analytics, Meta Pixel, or other advertising tracking technology on pestbrief.com.

Data retention

We retain account data for the duration of your subscription plus 24 months, after which it is deleted or anonymized. Usage logs are retained for 12 months. Email communication history is retained for 36 months. You may request earlier deletion as described below.

Your rights

You may request access to, correction of, or deletion of your personal data at any time by emailing support@pestbrief.com. We will respond within 5 business days. Newsletter unsubscribe links are included in every email. If you are located in the European Economic Area or California, you may have additional rights under GDPR or CCPA — contact us to exercise them.

Operator data in our database

Pest control operator records are derived from public licensing registries (Texas Department of Agriculture), public business records (Secretary of State, SBA filings, DOT), and third-party enrichment of publicly available information. These records describe businesses and their business-context activities — they are not personal data subject to privacy deletion requests under most applicable law.

If you are a pest control operator who believes a record about your business is materially inaccurate, contact us at support@pestbrief.com with supporting documentation and we will review within 5 business days. Correction requests for factual errors in public records are handled in good faith.

Security

We implement reasonable technical and organizational measures to protect your data, including TLS encryption in transit, access controls, and regular security reviews. No system is perfectly secure; if you become aware of a security vulnerability, please disclose it responsibly to support@pestbrief.com.
